International Criminal Court judges yesterday ordered four prominent Kenyans, including two potential presidential candidates, to stand trial for allegedly orchestrating a deadly wave of violence after their country’s disputed 2007 presidential election. Chief prosecutor Luis Moreno-Ocampo had asked to bring two separate cases, reflecting the political and ethnic divisions behind Kenya’s post-election violence. EEOC trial attorney Jeff Lee said Samantha Elauf, now 20, is an “all-American girl” but suffered disillusionment and emotional distress as a result of the company’s decision. However, Abercrombie attorney Mark Knueve told the four-man, two-woman Tulsa federal court jury that Elauf was able to find another job at the mall within five days and is not entitled to damages. U.S. District Judge Gregory Frizzell has already found the company failed to show that granting Elauf an exception to its “Look Policy” would have caused it undue hardship.
